Workshops/Shadow Programs

All payments are NON-refundable. They are transferable to another workshop or shadow program.

Subscription Memberships 

Certain products and services within Heather's Heroes Offerings may be provided on an ongoing basis through a recurring subscription. The subscription payment processor for the Heather's Heroes Offerings is PayPal, Inc. To cancel your subscription, you must follow the cancellation process with PayPal. Instructions on how to cancel your subscription through PayPal can be found here.

Your subscription rate is guaranteed for as long as you remain subscribed without cancellation. PayPal will notify you of any issues processing your payment before attempting a second time. After a second unsuccessful attempt, there is a risk of account cancellation. Maintaining up-to-date payment details is your responsibility to avoid unintended cancellation of your subscriptions. If you cancel, any discounted rate you were previously eligible for will be forfeited. A cancelled subscription cannot be reactivated. Should you wish to re-subscribe, you can do so from the sales page at the current subscription rate.

While you can cancel your subscription anytime, please note that subscription payments are non-refundable. To prevent future payments, you must cancel your subscription through PayPal before the next payment is due. Cancelling before the next scheduled payment ensures you will not be billed for future payments. The cancellation of your subscription also terminates your access to all membership content, including live calls, replays, member resources, and social media group access restricted to paying members. It's important to note that unsubscribing from membership emails (updates, call reminders, replay notices) is distinct from cancelling your subscription payment.

No Warranties for Heather's Heroes Offerings

Heather's Heroes Offerings makes no warranties regarding the performance or operation of the program. The Program further disclaims any representations or warranties of any kind, whether express or implied, as to the information, contents, materials, documents, programs, products, books, or services included in or through the Heather's Heroes Offerings. To the fullest extent permissible under the law, the Program disclaims all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability 

You agree to absolve Heather's Heroes Offerings of any and all liability or loss that you or any person or entity associated with you may suffer or incur as a result of the use of the information contained in the program and/or the resources you may download from the program. You agree that Heather's Heroes Offerings shall not be liable to you for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for the use of the program.

The information, software, products, and services included in or available through Heather's Heroes Offerings may contain inaccuracies or typographical errors. Changes may be periodically added to the information within the program. Heather's Heroes Offerings and/or its suppliers may make improvements and/or changes in the program at any time.

Heather's Heroes Offerings and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics contained in the program for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided "as is" without warranty or condition of any kind. Heather's Heroes Offerings and/or its suppliers hereby disclaim all warranties and conditions regarding this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by applicable law, in no event shall Heather's Heroes Offerings and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever, including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the program, with the delay or inability to use the program or related services, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the program, or otherwise arising out of the use of the program, whether based on contract, tort, negligence, strict liability, or otherwise, even if Heather's Heroes Offerings or any of its suppliers has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the program or with any of these terms of use, your sole and exclusive remedy is to discontinue using the program.

Arbitration

By participating in Heather's Heroes Offerings, you expressly waive any and all claims, current or future, arising from or related to the program, Heather's Heroes Offerings, any contracts entered into with the Program, and any products and services offered by the Program.

In the event you seek to assert such a claim, you agree to pursue resolution exclusively through binding arbitration to take place in Draper, Utah. You also waive any entitlement to class arbitration and commit to engaging in arbitration solely for individual claims brought by you and/or any affiliated entity. You acknowledge and agree that, to the maximum extent allowed by law, you are responsible for all costs associated with initiating the arbitration and administering the arbitration process.

International Users

Heather's Heroes Offerings is managed, operated, and administered by the Company from our offices within the USA. If you access Heather's Heroes Offerings from a location outside the USA, you are accountable for adhering to all local laws. By agreeing to these terms, you commit not to utilize the Heather's Heroes Offerings content in any country or manner that contravenes any applicable laws, restrictions, or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless Heather's Heroes Offerings, its officers, directors, employees, agents, and third parties from any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) related to or arising from your use of or inability to use the program or services, any user postings made by you, your violation of any terms of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. Heather's Heroes Offerings reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such a case, you agree to fully cooperate with Heather's Heroes Offerings in asserting any available defenses.

Termination and Access Restriction 

Heather's Heroes Offerings reserves the right, at its sole discretion, to terminate your access to the program and its related services or any part thereof at any time, without prior notice. To the maximum extent permitted by law, you hereby agree to resolve any disputes arising under or related to Heather's Heroes Offerings or the Terms through the Arbitration Clause mentioned above. Use of Heather's Heroes Offerings is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

No Joint Venture or Other Relationship

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship is established between you and Heather's Heroes Offerings as a result of this agreement or your use of the program. The performance of this agreement by Heather's Heroes Offerings is subject to existing laws and legal processes. Nothing in this agreement diminishes Heather's Heroes Offerings’ right to comply with governmental, court, and law enforcement requests or requirements related to your use of the program or information provided to or gathered by Heather's Heroes Offerings in connection with such use.

If any part of this agreement is deemed invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations stated above, the invalid or unenforceable provision will be replaced by a valid, enforceable provision that best aligns with the intent of the original provision. The remainder of the agreement shall continue in effect.

Entire Agreement

Unless otherwise specified herein, this agreement, along with the Privacy Policy, constitutes the entire agreement between the user and Heather's Heroes Offerings concerning the program, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Heather's Heroes Offerings regarding the program. A printed version of this agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. The most current version of the Terms will supersede all previous versions. Your continued use of our Service after any revisions become effective indicates your acceptance and agreement to the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service. We encourage you to periodically review the Terms to stay informed of our updates.
